**DEPOSIT & PAYMENTS:**  
I hereby acknowledge and agree that the required deposit is non-refundable. However, it is transferable to other offered Adventures pending availability and will expire 2 years after initial Adventure signed up. Final balance of booking fee is required three months prior to departure date. Failure to meet this requirement will result in a potential cancellation of your reservation.

**CHANGES TO AGENDA & CANCELATION OF ADVENTURE:**  
Given the intimate size of our groups, the itinerary is evolving and may change frequently as it is a highly customized experience. The exacting details we require of our partners to make your trip perfect take many months to curate. As we personally curate the experience for you, some venues do not meet the lofty standards and we make decisions to change venues in an effort to create the finest Adventure possible. We are in the process of designing each day and will have it published when everything is as perfect as you … and we …expect it to be. In addition, in the event of a very unfortunate unforeseen circumstance, your adventure may be canceled or change to a different date. You will be immediately notified and given the option to either accept the new dates being offered or a refund of your booking fee only less the nonrefundable deposit which can be used against another Adventure pending availability. With that said, we are a small and intimate company that will do our absolute best to accommodate any unforeseen situation.

**AGREEMENT TO PARTICIPATE:**  
I hereby acknowledge and agree to participate in travel activities organized by Reserve Tastings Wine Company LLC (aka: Mindi Abair’s Wine + Jazz Adventures) (dba: WINEandJAZZ.com), hereinafter referred to as "The Company". I understand that the travel may involve various activities that may be considered hazardous or involve risks to my safety, health, or personal property. I voluntarily participate in these activities with full knowledge of the inherent risks involved.

**ASSUMPTION OF RISK:**  
I am aware that travel, including but not limited to, transportation, accommodation, and recreational activities, inherently involves risks that may cause various physical injuries, illness, death, or loss and damage to personal property. These risks include but are not limited to: acts of nature, terrorism, civil unrest, epidemic diseases, and all forms of transportation failures. I hereby assume all risks associated with participation in any and all activities arranged by The Company.

**RELEASE AND WAIVER OF LIABILITY:**  
I hereby release, waive, discharge, and covenant not to sue The Company, its officers, agents, or employees (collectively referred to as "Releasees") from any and all liability, claims, demands, actions, and causes of actions whatsoever directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me or any property belonging to me, while participating in such activity, or while in, on or upon the premises where the event is being conducted, while in transit to or from the premises, or in any place or places connected with the event.

**INDEMNIFICATION:**  
I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs they may incur due to my participation in said activities. I understand and agree that this Waiver and Release of Liability includes any claims based on the actions, omissions, or negligence of the Releasees, whether a COVID-19 infection occurs before, during, or after participation in any Reserve Tastings Wine Company LLC (aka: Mindi Abair’s Wine + Jazz Adventures) (dba: WINEandJAZZ.com) program.

**ACKNOWLEDGMENT OF UNDERSTANDING:**  
I have read this Waiver and Release of Liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

**AGREEMENT TO FOLLOW DIRECTIONS:**  
I agree to follow the directions of the guide or staff during any activities and recognize that any failure to do so may result in harm or risks to myself or others.

**PHOTOGRAPH AND VIDEO RELEASE:**  
I consent to the use of photographs and videos taken during the trip for the promotional, advertising, and other purposes of The Company.

**GOVERNING LAW:**  
This agreement shall be governed by and construed in accordance with the laws of Sonoma County, California.

**SIGNATURE:**
